RESIDENTS INFORMATION
NERJA TOWN HALL
In 1992 the various municipal rates were abolished and replaced by a single tax
on property - I.B.I. (rates). This tax corresponds to 0.7% of the cadastral value of the
property. It is obligatory for all persons who own property (house, land, building plot,
garage, etc.) and is paid annually. Consequently, unless you have a car, garage, vehicle
entrance, trade, plan to build a house, this will be the only municipal tax you will have
to pay each year.
If the property is new you will receive the IBI payment notice after some years. On this
first receipt will appear the previous years but without any surcharge. The payment
should be made in the Tax Collection Office, Calle Diputación 2, Nerja, Monday to
Friday, 9.00 to 13.30 p.m.) The builder must register new building works at the Malaga
Cadastral Office.
Upon buying a property, the new owner must change the name on the IBI receipt from
the previous owners to his own. To do this he should provide the following documents to
the Rentas Department, 2nd floor of the Town Hall, Monday to Friday 10.00 - 14.00 p.m..
Photocopy of the Deeds - Photocopy of Passport / Residence card / N.I.E. - Photocopy
of the last I.B.I. receipt. Also if you believe that there is some mistake on your receipt
you must go to the Rentas Department . Amendments will be made free of charge.
Plusvalia is the tax due on the increase of the value of the land and is paid only once
per purchase/sale or change of ownership of a building (inheritance gift). The amount of
the Incremental Tax depends on the cadastral value of the property and on the years
elapsed since the last sale. The longer it is since the last sale, the greater the amount
to pay. The cadastral value is determined by the State and depends on the situation,
number of metres and age of the property. For example, a house of
100 sq. metres in an urban zone will have a greater cadastral value than a house of
100 sq. metres in a rural zone. The cadastral value tends to be less than the
purchase/sale value. According to law, this tax should be paid by the vendor. Nevertheless
payment should be made in accordance with the agreement stated in the Deeds. The
local custom is for the buyer to pay all the expenses. In the case of failure to pay this
tax, action will be taken against the seller. Once the Deeds are signed in the Notary's
Office, you will receive notice to pay the Plusvalia and will have a period of 20 days from
the date of receipt to effect payment. Payments must be made in cash or with a
certified bank cheque in the Rentas Department of the Town Hall, open Monday-Friday
10.00 to 14.00 p.m.
Persons who own a garage or an entrance permitting the access of a vehicle to a house
or a building, are subject to this tax. The tariffs are as follows:
Individual Garage -
Up to 3 meters of frontage 10,000 pts. per annum
Each meter of additional frontage 3,000 " "
Communal Garage -
With 2 places 5,000 pts. per annum

Each meter of additional frontage, shared proportionally among the garages 3,000 pts.
Each vehicle entrance should display the "Entrance in Use" sign so that people do not
park in front of it. If a vehicle should obstruct the entrance, you may call the tow-away
truck to take it away. This sign costs 4,500 pts. and is payable only once and should
be requested at the Rentas Dept. of the Town Hall.
BUILDING PERMITS
A Building Permit must be requested for any construction work, be it inside or outside
the house. To do this, before starting the work, the Planning Department, 1st floor of
the Town Hall, Monday to Friday 10.00 to 14.00 p.m.must be approached and
complete an application indicating the total budget of the work. This budget must
include the price of material and of the masonry labour, electricity, carpentry, even if the
work has to be accomplished by the owner, it must be quoted at a professional rate.
All works must have a licence before beginning. This licence can be requested by
the owner of the house, a Representative of the owner or the builder. The Representative
and/or builder should present a notarised Power of Attorney from the owner, issued in Spain
or in his country of origin in Spanish, or in a bi-lingual Spanish/own language format.
The document costs approx. 7,076 pts.
Alterations to an already existing building are considered Small Works, for example -
Changing the floors. Changing the tiles. Building or removing partitions in the interior
of the house. Placing or removing doors, windows, gratings. Tiling a garden or terrace.
Adding decorative girders/pergolas to a garden or terrace. Raising the walls
of the garden. These works do not need plans and after payment the permit is
granted the same day on which it is requested.
The extension or construction of a new house is considered Large Works. For example -
Building a new house. Building new rooms, garages, ceilings. Building an additional floor.
Roofing over a terrace or garden.These works need plans approved by the College
of Architects. The Architect's fees to draw up these plans vary around 5 to 10% of the
value of the work and do not include the cost of the building permit.
The cost of the building licence is calculated inaccordance to the work budget as follows -
Work up to 50,000 pts. 0 pts.
Work from 50,000 to 107,000 pts. 5,000 pts.
Work from 107,000 to 200,000 pts. 5,000 pts. + 2.8% work budget
Work more than 200,000 pts. 5.3% work budget
When building a house in a rural zone, the requirements are that the plot should not be
affected by urban planning restrictions and the area has the following minimal dimensions -
Irrigated Property 5,000 sq. m. a house up to 250 sq.m. is permitted

The Building Permit is granted by the Planning Department of the Town Hall only if -
The house is in a legal urbanization or legal zone. The volume of the house permits it
according to the regulations. It is approved by the Town Hall.
Once the work is finished, it will be surveyed by a municipal technician. If the value
of what is built exceeds the amount requested in the licence, you will have to pay the
difference.
If during the work, you have occupied the street or the sidewalk with construction
materials, rubble, or other waste, you will receive, upon completion of the work, a notice
to pay the Public Way Occupation Tax whose amount is between 15 and 60 pts./m/day.

If you do not request a licence or what was built does not correspond with what was
requested, you will have breached Planning and will be subject to a fine. This fine will
vary between 1% and 5% of the budget of the work if the construction is legal, and
between 10% and 20% if the housing is not legal, in which case demolition proceedings
will be initiated. Apart from the fine, you will have to pay the construction licence
of the completed work which will be evaluated by the technical personnel of the
Town Hall.
Before beginning any work, you should request a written budget which details exactly
all the projects to be accomplished and the quality of the material (brand and class of
tiles, floors, taps, thickness and quality of doors) from the building company or agency.
The budget should contain the following data -
Identification of the company who are to execute the work. Identification of the
applicant. Description of the project with the price of labour and materials. Total price
including taxes. Limit date for finishing the work. Date and signature of the builder or
professional. Date and signature of the applicant. Guarantee. Form of payment.
Normally the budgets are free. During th ework the constructor is responsible for any damage
which he or his workers cause to the house or other persons or houses.
PAYMENT OF TAXES:
Date of Tax Payment:
All receipts are annual. Normally Road Tax can be paid from March to May and I.B.I.
from June to September.. The time to pay a receipt may vary from year to year. From
the date of issue of the receipt you will have approximately 3 months to pay.
Place and form of payment of the Municipal Taxes:
There are two ways to make these payments:
(1) By Banker's Standing Order. The bank makes the payment and it is the most effective
way since it avoids surcharges and the need to find out when a given receipt is due for
payment.
You will have to fill in an authorisation in the Tax Collection Office where they will give
you two copies, one which you must take to your bank. You will not be able to request
a banker's order if there are any pending payments and it is to be applied for before receipts
are made payable.
(2) At the Tax Collection Office. In the Nerja Tax Collection Office, Calle Diputacion 2,
Monday to Friday 9.00 to 13.30. If you do not have the payments made by direct debit, the
Tax Collection Office will send you a notice when each receipt is due for payment,
indicating the final date for payment. Subsequently, you will have to take the payment notice
to
Unicaja Savings Bank in Plaza de la Ermita and pay it there.
The receipts which are not paid within the prescribed dates will have a 20% surcharge,
plus interest and costs if legal action is taken. After a given time if payment has not been
effected, the Tax Collection Office will proceed to embargo bank accounts and thereafter
embargo property.
The census is the official record of the inhabitants of a municipality registered at the
Town Hall. The electorate census is established from this record, made up of persons
over 18 years, all those with the right to vote. The census is of great importance since
depending on the number of inhabitants of a municipality, such will be the economic
contribution of the Central and Regional Administration to cover the following services -
Municipal Services: Local Police, Garbage, Water, Sewerage, Street Lighting, Roads.
State Services:
National Police, Doctors, Hospitals, Colleges, Civil Guard, Highways, Courts.
All persons who normally reside in a municipality have the obligation to register in the
Census of that municipality. If a person resides in several localities in turn, he must be
registered in the place where he resides for the greatest time. A person may not be
registered in two or more municipalities at the same time. Registration is limited to
one only. If a person wishes to live an another municipality, he will have to request from
the Town Hall a document showing his removal from the census and then present this
document to the Town Hall of the new municipality where he is going to reside. The
Registration on the Census is free and can be accomplished at any time of the year.
All foreigners with residence permits are obliged to be registered, as do all the Spanish
residents. For this they will have to present their residence card in the Census Dept.

showing that a residence permit has been requested will not be accepted. In this office
a form will be filled in with your domicile and your personal data. If you have been residing
in another municipality you must request a deregistration document of that Town Hall
and present this in the Town Hall of Nerja.
Persons who are registered will be able:
(1) If Spanish, to vote or stand in the local, national and European elections. Foreigners
will be able to vote or stand in these elections, so long as this is agreed in the
International Treaties.
(2) To request cohabitation, residence and registration certificates, which they will need
for: collecting unemployment and pension payments. Requesting medical assistance
in the Outpatients Department of the Social Security. For various procedures with
the Administration.
Also a foreigner will need a Residence Certificate to buy a car in Spain, and a
Registration Certificate to be a member of the Pensioners Home. These certificates cost
500 pts. and may be requested in the Census Dept. ground floor of the Town Hall.
REVISION OF THE CENSUS:
The census is renewed every 5 years and the next revision will take place in 1996.
For this, several personnel of the Town Hall will go from house to house taking the
relevant data. If for any reason they do not go to your house, you will have to go to the
Census Department and give the necessary data. If you were registered in the previous
census and no one takes any data when the new census is being checked, you will be
excluded.
Those foreigners whose residence cards have expired and who, within 6 months, have
not presented an up to date card to the Census Dept. will also be excluded.
CHECKING THAT YOU ARE REGISTERED:
In order to check that you are registered, it is necessary to present yourself in the Census
Department to be sure that you figure in the census and that there is no mistake in your
personal data. This checking is essential at election time since if you do not figure in it,
or there are any mistakes in your identification data, you will not be able to vote. Also,
if there are any changes of domicile, these must be notified to this Department.
SALE AND PURCHASE OF A PROPERTY:
In order to avoid problems it is important before buying a dwelling, land or any property,
to ascertain its urban situation and if there are any pending payments. For this
information will have to be requested from the following offices -
(1) Town Planning Department of the Town Hall, 1st floor. open Monday to Friday,
10.00 to 14.00. here they will indicate the property's location in the town and the
possibility or not of building. The information provided by the Town Hall overrules any
information given by an agency or other person.
(2) Property Registry, Calle Calzada 10, Torres, open Monday to Friday 9.00 to 14.00.
This office will inform you if the property is registered in the Property Register and if
there is any mortgage, lien or change. It is advisable to request a Nota Simple which
specifies that the property is free of charges. This will cost 580 pts. and is
obtainable on the same day.
(3) Tax Collection Office, Calle Diputacion 2, Nerja. open Monday to Friday 9.00 to 13.30.
This office will indicate if there are minicipal taxes pending payment. You should also check
if there are receipts pending payment at the following offices -
(4) Sogesur Water Company, Calle Malaga, Edificio Las Palmeras, Nerja, open Monday to
Friday 9.00 to 14.00.
(5) Sevillana Electricity Company, Calle Cristo 16, Nerja, open Monday to Friday 8.30 to
13.30.
(6) Owners Community Association, if the building belongs to a community.
It is of prime importance that the property has a public title deed Escritura in which the plot
as well as the house is shown. To draw up the title deed of a building from 1990, the
constructor will have to present the Building and First Occupation Licences to the Notary
Calle Jaen, Edificio Tomé, open Monday to Friday 10.00 to 15.00. The Town Hall will only
grant this licence if the dwelling satisfies all the town habitation and planning requirements.
If a house has taxes, community and other receipts pending payment, we advise you not
to complete the purchase until the current proprietor pays the obligations or the amount of
the outstanding payments is deducted from the purchase price of the house, so that you
could pay them. If you wish to take over the mortgage, you will have to request from the
proprietor the 6 last receipts paid to prove that there are no pending amounts and to check
in the bank if you can continue the payment of this mortgage.
If the house you wish to buy is not yet completed, it is advisable to withold a part of
the amount payable in order to guarantee thre finalisation of the house as well as the streets,
the infrastructure and the green zones.
A few days after you have signed the Title Deed Escritura, a First Copy Copia Simple will
be available from the Notary. This copy indicates that a deed of sale and purchase has beeneffected in front of a Notary, but it will not have validity until it has been registered in
the Property Registry in Torrox.This registration in Torrox may be made by the Notary, an
Adviser's Agency Gestoria or yourself.
Once you have bought the property, the following receipts should be changed to the
name of the new owner: Rates (I.B.I.) (2nd floor of the Nerja Town Hall), Electricity
(Compañia Sevillana, Calle Cristo 16, Nerja), Water (Compañia Sogesur, Calle Malaga,
Edificio Las Palmeras, Nerja).
COSTS OF PURCHASING A PROPERTY:
Upon buying a property, you will have to pay the following expenses:
1. NOTARY CHARGES: The amount depends on the value which is shown in theTitle
Deed, shared between the buyer and the seller. Nevertheless, this will be paid as agreed
between both parties (usually it is paid by the buyer).
2.PROPERTY REGISTRY CHARGES (Torrox):
The amount depends on the value shown in the Title Deed.
3.VAT / IVA or TAX ON TRANSFER OF PROPERTY /TRANSMISIONES PATRIMONIALES:
New Buildings: 7% VAT + 0.5% tax on Legally Registered Documents Actos Juridicos
Documentados of the value shown in the Title Deed for the purchase of:
(a) Dwellings. (b) Garages situated in the same place as the dwelling and bought on
the same date.
16% VAT + 0.5% Tax on Legally Registered Documents of the value shown in the Title
Deed
for the purchase of:
(a) Garages bought in a different place and on a different date to the dwelling.
(b) Commercial premises.
The VAT will be paid directly to the builder or to the Public Treasury Office Hacienda in
Vélez
-Malaga or Malaga. The o.5% Tax on Legally Registered Documents will be paid to the
Property Registry Office Registro de la Propiedad of Torrox.
RESALES AND LAND:
6% Tax on transfer of Property Transmisiones Patrimoniales of the value shown in
the Title Deed, for the purchase of: (a) Resales (buildings which previously have been
sold).
(b) Land. This tax will be paid to the Property Registry Office of Torrox.
4.INCREASE LAND VALUE TAX / PLUSVALIA: (Town Hall)
The amount depends on the cadastral value of the house and on the years elapsed since
the last sale. To know the exact amount payable, you can obtain information in the
Rentas Department (2nd floor Town Hall) of Nerja).
5.10% PUBLIC TREASURY:
This will only be applied to persons who buy a house from a Non-Resident foreigner.
The buyer is obliged by law to withhold from the seller 10% of the value shown on the
property Title Deed. This amount is withheld for the purpose of guaranteeing that the
seller pays the taxes relating to the sale, which will be settled in his next tax declaration.
WATER
Upon buying a house, the water meter should be put in the name of the new proprietor.
This procedure is free and request should be made to the Sogesur Water Company in
Nerja, Calle Malaga, Edificio Las Palmeras, open Monday to Friday, 9.00 to 14.00. The
sale and purchase title deed must be presented and any outstanding payments from the
previous ownership must be paid. If the new owner does not wish to settle these
obligations, he will have to request the installation of a new meter and for this he will have
to present several documents certifying the suitability for habitation of the dwelling and
pay 15,650 pts. (for a meter up to 15mm.) plus an amount for the material used if
it is necessary to make some modification.
TARIFFS FOR THE CONSUMPTION OF WATER:
The minimum charge to pay for a standard type meter up to 15mm. is 1,311 pts. every
three months, an amount which will have to be paid whether the property is inhabited
or empty. This tariff corresponds to 30 cubic metre of water. If the consumption is more
than this quantity and does not exceed 60 cubic metre, the price of each cubic metre of
additional water is 40 pts.
DISCONNECTION OF WATER BECAUSE OF NON-PAYMENT:
Each water bill has a payment term of 1 month. Beyond this period, the Sogesur Water
Company will send a notice by registered letter. If the payment is not made within 15 days
following the notice, the water supply will be cut off. The amount to connect the water
again is 3,828 pts. plus the outstanding debt.
ELECTRICITY
Upon buying a house, the electricity meter should be put in the name of the new owner.
The following documentation has to be presented to the Sevillana Electricity Company of
Nerja, Calle Criston 16, open Monday to Friday, 8.30 to 13.30.
RESALE PROPERTY:
Title Deed of the property, Passport/National Identity Document/Residence Card of the
new owner. Bank account number to pay the bills by standing order. Payment of
7,919 pts. (for a meter of 4,400 watts).
NEW PROPERTY:
Apart from the above, you must present: Report from electrician who carried out the electrical
installations. First occupation licence from the Town Hall, this licence will only be granted
if the building satisfies all the town planning and habitation requirements. Payment of
22,295 pts. (for a meter of 4,400 watts).
TARIFF:
Upon contracting the electricity supply, you may choose the power capacity to be installed
according to your needs, taking into account that each power capacity chosen incursa
different tariff. All the bills have a standing charge which will have to be paid whether the
house is
inhabited or empty. Apart from this, they will invoice you for the electricity consumed. As
a rough guide, a contract for 4,400 watts will incur every two months a standing charge of
2,720 pts. plus the actual consumption.
DISCONNECTION OF ELECTRICITY BECAUSE OF NON-PAYMENT:
Each electricity bill has a payment term of 15 days. Beyond this period the Sevillana
Electricity Company will send you a notice by registered letter. If the payment is not made
within 15 days following the notice, the electricity supply will be cut off. The amount to
connect the
electricity is 3,343 pts. plus the outstanding debt. It is advisable to give the details of a
second address in case you are absent.

TELEPHONE:
Applying for a Telephone: It is necessary to present in the office of Telyco in Nerja, Calle
Edificio Atalaya, open Monday to Friday 9.30 to 13.30 and 17.00 to 20.30, Saturday
10.00 to 13.30, the following documents:
Photocopy of Passport/Residence Permit/National Identity Document, Title Deed
of the property where you wish to install the telephone. If you do not possess a
residence permit or property deeds, you will have to present your N.I.E. (Foreigners
Identification Number).
TARIFFS:
The installation charge will be 27,250 pts. + IVA. There is a special charge for persons older
than 64 years or with total disability who have reduced economic means. This special
tariff goes up to 9,375 pts. + IVA.
CONSUMPTION TARIFFS:
All bills have a standing charge which must be paid whether the property is inhabitated
or empty. In addition you will be billed in accordance with consumption. As a guide, a
standard telephone will have a Bi-Monthly standing charge of 3,461 pts. plus charges for calls
made.
HOW TO MAKE TELEPHONE CALLS:
To make a telephone call within the Province of Malaga, it is not necessary to dial a prefix.
As a guide, we indicate herewith some of the towns of Malaga Province: Frigiliana, Torrox,

of the subscriber.

RESIDENCE CARDS:
The maximum time a tourist can stay in Spain is:
(a) European Community Citizens - 6 months.
(b) Non European Community Citizens - 3 months or the time specified in their Visa.
They may stay an additional period of 3 months if they request an extension from the
Police Station of Torre del Mar. Beyond this period it will be necessary to leave Spain
or apply for a residence card if you wish to reside on a regular basis in this country.
A person who during a year resides more than 6 months in Spain, either continuously
or sporadically, must request Spanish residence.
APPLYING FOR A RESIDENCE CARD:
The Residence Card is applied for at the Police Station in Torre del Mar (Avenida
Andalucia 3, open Monday to Friday 09.00 to 14.00). You may begin the application
procedure from the moment you decide to reside on a regular basis in Spain. It is
not necessary to wait for three months to elapse as it can be requested from the first
day you come to live in Spain. The Residence Card takes from 2 to 6 months to obtain
and meanwhile you will have your copy of the application form on which a provisional
foreigner's identification number N.I.F. will be shown.
TAKING POSSESSION OF THE RESIDENCE CARD:
It will be possible to collect your card in the Torre del Mar Police Station between 2 and
6 months from application. Once obtained, the Residence Card will imply the same
rights and duties as for a Spanish citizen.
DOCUMENTS TO PRESENT:
European residents must present the original and 2 photocopies of the following
documents:
1. Passport
2. 4 Photographs
3. Proof of economic means, for which they may present:
(a) A Bank certificate of their funds or regular income.
(b) Their Pension receipt, translated by the consulate.
4. Photocopy of their Medical Insurance, that may be:
(a) Certificate of E111 (National Insurance Institute in Vélez Malaga).
(b) A private Spanish or foreign, with representation in Spain, insurance.
5. Marriage Certificate (if appropriate),
6. 835 pts. in Papel del Estado, purchasable in any Tobacconist.
Also the Police Station may require any other document it deems necessary.
(b) NON-EUROPEAN COMMUNITY RESIDENTS
1. Residence Visa from the Spanish Consulate in their country of origin.
2. Certificate that they are registered with the Consulate of their country.
3. Penal certificate from their country of origin.
4. Title Deed or Rental contract.
5. Income Tax Declaration.
RENEWAL OF THE RESIDENCE CARD:
The first Residence Card will be valid for 2 years. The successive renewals will be valid
for 5 years. The renewal of the card should be applied in Torre del Mar Police Station
before the current card runs out.
TRAFFIC DEPARTMENT:
Due to the complexity and difficulty of the Traffic Department's procedures, you are
strongly recommended to use a Consulting Adviser. However if you prefer, you may do it
yourself.
BUYING A CAR:
A foreigner will be able to buy a car in Spain only if he possesses one of the
following documents -
(a) Residence Card
(b) Property Deeds
(c) Rental Contract of a dwelling.
NEW CARS:
The dealer where you buy the car or an Adviser's Agency will take care of effecting the
registration, the charge for which is approximately 20,000 pts. + Licensing Tax = 13%
of the car`s value.
USED CARS:
Upon buying a used car you will have to make a contract of sale and effect the transfer
of the vehicle.
1. CONTRACT OF SALE - This contract can be made by the interested party and it will have
to
show the following:
Details of the buyer and of the seller, name, passport/residence card and domicile.
Data of the vehicle, model and registration number.
Price of the sale.
Form of
payment.
That the vehicle is free of charges.
Date of the contract.
Signatures
of the buyer and the seller.
Subsequently the seller will have to present the original contract and a copy of the contract
to Trafico, Calle Mauricio Moro 13 in Malaga, open Monday to Friday 9.00 to 14.00.
With the copy duly stamped by Trafico, the seller remains exempt from any responsibility
for fines, accidents or traffic taxes which the vehicle could have in subsequebt years.
You must then present this stamped copy to the Nerja Town Hall Rentas Department, 2nd
floor, so that no future requests for payment of the Vehicle Tax are made to you.
2. TRANSFER OF PREVIOUS TITLE TO THE NEW OWNER:
To avoid journeys to Malaga and having to make the appropriate transactions in the
offices of Trafico, it is preferable that the transfer is undertaken by a Gestoria whose fees
are approximately 8,000 pts. plus vat. You may however resolve the matter personally.
The payment of the transfer fee will be made as agreed between buyer and seller.
Nevertheless, it is usual for the purchaser to pay. The amount of the transfer fee will depend
on the age and the cylinder capacity of the vehicle. As a guide, a 5 year old Ford Fiesta
might be approximately 30,000 pts. and a 2 year old motorcycle of 250cc. some 19,000 pts.
WHAT TO DO IF YOU HAVE SOLD YOUR CAR AND ARE STILL RECEIVING DEMANDS
FOR VEHICLE TAX:
If it is several years since you sold your car and yet you continue to receive the Vehicle
Tax, this means that the transfer was never effected. As such, you figure as the owner
of the car and are responsible for any tax, fine or accident expenses which it could have.
To definitely solve this situation, it is possible to opt for one of the following solutions -
1. To pay all the outstanding taxes at the Tax Office of Nerja, Calle Diputación 2 and
de-register the vehicle. Subsequently, present a copy of the de-registration to the Town
Hall of Nerja, Rentas Department, 2nd floor, in order to annul future vehicle receipts.
2. If your car was not sold, but you no longer possess either the vehicle or the
documents, you must do the necessary procedures in the Nerja Town Hall in order to cancel
the Road Tax demands.
BUYING A MOTORBIKE OR MOPED:
Purchase of a new motorbike:
(a) Motorbikes of more than 49cc. This involves the same procedures as a car.
(b) Moped of 49cc. Once the moped has been bought, it must be registered in the Rentas
Department, 2nd floor Town Hall, open Monday to Friday 10.00 to 14.00. For this you
will have to provide your identification document, the documents of the moped and
pay 3,270 pts.
Purchase of a Secondhand Motorbike:
(a) Motorbikes of more than 49cc. This involves the same procedure as a car.
(b) Mopeds of 49cc. To effect transfer you must present in the Town Hall, the identity
document of the buyer and the documents of the moped, signed by the buyer and seller.
This is accomplished on the same day and it is free.
TECHNICAL INSPECTION OF VEHICLES : I.T.V.(M.O.T.)
All cars, vans and motorbikes of more than 49cc. are obliged to undergo an inspection
periodically. Also, it is not permitted to buy, sell or insure a vehicle which does not have
an up to date I.T.V. certificate.
The inspections are carried out in : Algarrobo (road to
Algarrobo 2Kms. before arriving in this village, open Monday to Friday 8.00 to 18.30 and
Saturday 8.00 to 12.30 and in Motril, Highway Almeria, Km. 1.3 before Torrenueva open
Monday to Friday 9.00 to 13.00 and 16.00 to 19.00, Saturday 9.00 to 13.00. They can also
be
carried out in Malaga, Guadalhorce Industrial Estate, opposite the Sugar Factory, open
Monday to Friday 8.00 to 19.30, Saturday 8.30 to 12.30.
In Nerja it is usual to undergo the inspection in Algarrobo or in Motril, due to the fact that
there are not so many vehicles to be inspected as in Malaga. It is necessary to present
the Traffic Permit and Technical Inspection Card.
A new car will have to undergo inspection after 4 years
A car of 4 to 10 years " " every 2 years
A car of more than 10 years " each year
Price: 3,452 pts.
Motorbikes of more than 49cc.:
A new motorbike will have to undergo inspection after 5 years
A motorbike of 4 to 10 years " " every 2 years
A motorbike of more than 10 years " every year
Price: 2,160 pts.
VEHICLES WITH FOREIGN REGISTRATION:
A car with a foreign registration will not be permitted to stay in Spain more than 6 months.
Beyond this time the car will have to be removed from Spain or change its
registration for a Spanish registration. Also, it is possible to request an extension of
6 months so long as the owner can prove having sufficient means for that period.
CHANGING FROM FOREIGN TO SPANISH REGISTRATION:
This is a very complex procedure and it is advisable it be accomplished through a
Gestoria. The fees for this work will be approximately 50,000 pts. plus IVA. apart from
the charges of Trafico and Customs.
DRIVING IN SPAIN:
(a) Tourists: Tourists are allowed to drive in Spain so long as they have one of the
following documents - (1) Driving licence of their country of origin (2) International
driving licence.
(b) Resident Foreigners: Foreigners will have to change their foreign driving licence
for a Spanish one within a year of obtaining a Residence Card.
CHANGING A FOREIGN DRIVING LICENCE TO A SPANISH LICENCE:
As procedures are very complex, we recommend making them through a Gestoria whose
fee for this work will be approximately 10,000 to 12,000 pts. (total of the fees,
including Trafico's charges).
RENEWAL OF DRIVING LICENCE:
(a) From 18 to 40 years old the licence will be renewed every 10 years.
(b) From 40 to 45 " " " " " " from 10 to 5 years according to age.
(c) From 45 to 66 " " " " every 5 years.
(d) From 66 to 70 " " " " from 5 to 1 year " "
(e) From 70 " " " " " every year.
The renewal of a driving licence can be made through the post office, presenting
the necessary documents and paying 2,200 pts. in respect of Trafico's charges.
GENERAL OBLIGATIONS FOR DRIVERS:
Private cars may not travel faster than 50 km. per hour in urban areas and 120 km. per hour
maximum on motorways and dual carriageways.
It is obligatory to have -
A driving licence.
Valid third party insurance (Spanish Insurance Companies will not
insure foreign registered vehicles).
Original identification documents of the vehicle.
Technical inspection card and traffic permit. (photocopies are only admissable if they
are certified by a Notary, at a cost of 525 pts. per page, the Municipal Police,
Trafico or some Banks).
It is also obligatory to wear a safety belt in a car and a crash
helmet on a motorbike or moped.
If you commit some breach of traffic regulations outside the urban area and you get a fine,
you will have a 20% discount if you pay the said fine within 10 days, except for serious
fines. The payments will be made in the Trafico offices in Malaga. The same applies
to breaches of regulations within Nerja. In this case you will have to pay the fine in the
Rentas Department of the Town Hall or in the Municipal Police Station.
You should observe the existing signalling in all streets and especially we advise you not to
park in Calle Pintada (from the Bank Bilbao Vizcaya down to the Balcon de Europa) nor in
Plaza Cavana. If your vehicle is towed away then you must pay the corresponding fee before
taking your car. If you are not domiciled in Spain you will also have to pay a bond
on the fine.

SOCIAL SECURITY AND PRIVATE MEDICAL ASSISTANCE:
Resident Foreigners:
(a) Pensioners - Pensioners should bring from their own country Form E121 already
completedand together with their passport, present it in the National Institute of the Social
Security in Velez-Malaga, Calle Dr Fernando Vivar 1, next to the Outpatients Clinic
open Monday to Friday 9.00 to 13.30. You will then receive by post the Social Security
Card which will permit you to receive medical assistance and free medicines prescribed
by the Social Security.
(b) Non-Pensioners - Non-Pensioners should bring fromtheir own country Form E111
already completed and obtain photocopies of this form to present in any Social Security
Centre at the time of needing medical assistance. This form will have validity during
3 months. After this time if you are going to work, you will have to register with the
Spanish Social Security in Velez-Malaga. If you are not going to work and wish to have
a health insurance, you will have to contract a private insurance.
TOURISTS:
People who come on vacation to Spain should bring Form E111 already completed
from their own country and obtain photocopies to present in any Social Security Centre at the
time of needing assistance. If for any reason you do not have this form, in the event
of emergency, you will be attended to in any Social Security Centre. You will then be
given an invoice for the expenses incurred which you will have to pay at the Centre.
This invoice can be presented later to the Social Security of your own country so that
you can obtain a refund of the amount paid.
TARIFFS FOR PRIVATE CONSULTATIONS:
Charges for medical assistance in private conssultations vary between 2,000 and 4,000 pts.
approximately. A consultation with a basic analysis costs approx. 7,000 pts. Medical
invoices should not include V.A.T. / I.V.A.
TAXATION / HACIENDA:
1. Income Tax Declaration:
(a) Resident Foreigners whose family income exceeds 1,000,000 pts. or 1,200,000 pts.
if they are pensioners, should make an Income Tax Declaration as do families who
derive more than 250,000 pts. gross, of investment income or Capital Gains between
them.
The declaration period is from 1st May until 20th June and can be presented at any
Bank, Savings Bank or Public Treasury Office.
(b) Non-Resident Foreigners should make Patrimony and Income Tax Declarations of
all real estate they possess in Spain and of the income they receive in Spain. If you
only posess one dwelling for your own use you may present your declaration
(model 214) any time in the year. If you own more than one dwelling, or you rent it,
you must make your declaration (models 210 & 714) between the 1st May and 20th June.
Your declaration may be presented personally or by a Gestoria, whose fees vary from
7,000 to 10,000 pts. per return.
2. Fiscal Representative:
Resident Foreigners do not need a Fiscal Representative.
Non-Resident Foreigners do not need a Fiscal Representative if they only possess in
Spain one dwelling for their own use. They will need a Fiscal Representative in the case
that- (a) They possess more than one dwelling in Spain (b) They rent the Spanish
property which they own. Any foreign or Spanish resident can be their
Fiscal Representative.
BANKS:
HOURS OF OPENING TO THE PUBLIC:
Banks / Bancos, Monday to Friday 8.30 to 14.00, Saturday (only in winter) 8.30 - 14.00.
Savings Banks / Cajas de Ahorros, Monday to Friday, 8.30 to 14.00. Each bank
may have different opening hours.
Requirements for opening an account:
Anyone can open a bank account in Spain. It is only necessary to present your
Passport / Residence card / identity card. The opening of an account is free and it can
effect deposits and withdrawals from abroad without limit. If you wish, you can also open
an account in foreign currencies. All bank accounts, except Non Resident accounts,
are subject to the withholding of 25% of the interest earned for the Revenue.
THE POST OFFICE / CORREOS:
The Post Office in Nerja is in Calle Cristo 6, open Monday to Friday 8.30 to 14.00.
Saturday 9.30 to 13.00. The persons who reside in urbanizations who do not have a
mail delivery service should collect their letters from the Post Office, presenting Passport /
Residence Card / National Identity document. If you wish to collect the mail for
another person you will have to present authorisationand photocopy of an
identification document from that person.
CEMETERY:
Only those who wish to have a deceased relative or friend in a niche or tomb of the
Municipal Cemetery have to pay this tax. If you have burial insurance, the burial and the
tax to occupy a niche during the months that remain of the current year, will be paid by
the funeral directors. The following year, the cost of staying buried in the cemetery
will rise to:
In an already existing tomb of the family 5,000 pts./year
In a niche 2,000 " "
In a common ossary Exempt
If payment is not received for the following years, in the fifth year the body will be moved to
a common ossuary. The Cemetery Tax in the first year will be paid in the Rentas Dept.
2nd floor of the Town Hall. In following years the tax is payable in the Tax Collection Office
of Nerja, Calle Ditutacion 2. It is possible to pay in advance as many years as you wish,
only having to pay the difference if in successive years the tax is increased. The
payment must be effected in the Rentas Department of the Town Hall in cash or with a
certified bank cheque.
